Terms of Service


Effective Date: March 01.2026

These Terms of Service ("Terms") govern your access to and use of the PK Trading platform (the “Platform”), operated by PK Trading ("Company", "we", "our", or "us"), a New Jersey-based business-to-business (B2B) wholesale marketplace.

By accessing or using the Platform, you agree to be bound by these Terms.


1. Eligibility

The Platform is intended for business use only.

By using the Platform, you represent and warrant that:

  • You are at least 18 years old
  • You are authorized to act on behalf of a business entity
  • All information provided is accurate and complete


2. Account Registration

You agree to:

  • Maintain accurate account information
  • Keep login credentials secure
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts at any time.


3. Platform Role (Critical)

PK Trading acts solely as a facilitator of transactions between independent buyers and sellers.

We:

  • Do NOT manufacture or inspect products
  • Do NOT guarantee product quality, condition, legality, or accuracy
  • Are NOT a party to any transaction

All transactions are solely between users.


4. Orders & Payments

(1) Order Acceptance

Orders are subject to seller approval. Pricing and availability may change.

(2) Payment Terms

  • Payments are processed via third-party providers (Stripe, PayPal, etc.)
  • Full payment may be required prior to shipment

(3) Fees

Platform fees may apply and will be disclosed prior to purchase.


5. Returns, Refunds, and Claims

(1) B2B Final Sale Policy

All sales are final unless otherwise agreed in writing.


(2) Claim Deadline (Strict 10-Day Rule)

All claims must be submitted within ten (10) calendar days from the confirmed delivery date.

This includes:

  • Damaged goods
  • Missing items
  • Incorrect shipments
  • Defective products

Any claims submitted after 10 days will be automatically denied and permanently waived.


(3) Inspection Responsibility

Buyers are responsible for inspecting all goods immediately upon receipt.

Delivery shall be deemed acceptance of goods unless a valid claim is submitted within the 10-day period.


(4) Claim Requirements

All claims must include:

  • Order number
  • Detailed issue description
  • Photo or video evidence

Incomplete claims may be rejected.


(5) No Return Without Authorization

Returns are NOT accepted without prior written approval.

Unauthorized returns may be:

  • Refused
  • Discarded
  • Returned at buyer’s expense


(6) Partial Use / Resale Restriction

Products that have been:

  • Used
  • Altered
  • Resold

are not eligible for any claims or refunds.


(7) Dispute Handling

  • Buyers must first contact sellers directly
  • PK Trading may assist but has no obligation to intervene


(8) Chargeback Policy (Important)

Users agree to:

  • Attempt resolution before filing disputes
  • Provide notice prior to initiating chargebacks

Improper or abusive chargebacks may result in:

  • Account suspension
  • Permanent termination
  • Legal action


6. Shipping & Risk of Loss

  • Shipping timelines are estimates only
  • Delays are not the responsibility of PK Trading
  • Risk of loss transfers upon shipment unless otherwise stated


7. Intellectual Property

All platform content is owned by PK Trading or licensors.

Unauthorized use, copying, or distribution is prohibited.


8. Prohibited Conduct

Users may not:

  • Provide false information
  • Engage in fraud
  • Disrupt platform operations
  • Violate applicable laws


9. Limitation of Liability (Very Important)

To the maximum extent permitted by law:

PK Trading shall NOT be liable for:

  • Product defects or quality issues
  • Shipping delays or losses
  • Business losses, lost profits, or data

Total liability shall not exceed the total fees paid to PK Trading in the past 12 months.


10. Indemnification

You agree to indemnify and hold harmless PK Trading from any claims arising from:

  • Your use of the Platform
  • Your transactions
  • Your violation of these Terms


11. Termination

We may suspend or terminate access at any time for:

  • Violations
  • Fraudulent activity
  • Business or legal reasons


12. Governing Law

These Terms are governed by the laws of the State of New Jersey.


13. Dispute Resolution

(1) Informal Resolution

Parties agree to attempt resolution first.

(2) Binding Arbitration

All disputes shall be resolved via binding arbitration in New Jersey.

(3) Class Action Waiver

Users waive the right to participate in class actions.


14. Modifications

We may update these Terms at any time. Continued use = acceptance.
